Universal Jobmatch website – Standards of Behaviour for Jobseekers

1. This page (taken with the documents and pages it refers to) explains DWP's expectations from those using the Universal Jobmatch website to look for job vacancies.

1.1 In this document, “Our”, “Us” or “We” means the Department of Work and Pensions “DWP” of Caxton House, Tothill Street, London SW1H 9DA.

1.2 “Site” means this Universal Jobmatch website.

1.3 If you wish to contact Us for any reason, including complaints you can contact Us by using this 'Contact us' link.

2. Using the Site

2.1 These clauses provide the basis on which you can use the Site and sets outs the standards of behaviour which We expect from users of the Site.

2.2 This Site is provided for the purpose of providing information about employment and career opportunities and for recruitment by employers and business owners.

2.3 For the purposes of the Employment Agencies and Employment Business Regulations 2003 this Site operates as a venue only and does not introduce or supply work-seekers to recruiters (or vice versa).

2.4 Since this Site is only a venue you need to undertake appropriate checks to ensure both your suitability for the role advertised and of the role itself. For example, checking the identity of the recruiter and the nature of its business, the commencement date and duration of the position, the position to be filled, location, hours and risks to health and safety, experience, training, qualifications and authorisation which the recruiter considers necessary or are required by law or otherwise to undertake the position, whether any expenses are payable by you as a work-seeker or whether there are any requirements imposed by law or otherwise for you to satisfy before taking up a position. Clause 8 below sets out further guidance in relation to safe use of the Site.

2.5 We aim to update the Site regularly, and may change the content at any time without notice.

3. Ownership and Reuse of this Site.

3.1 This Site is protected by intellectual property rights and this clause sets out the intellectual property rights that We do have in the Site and the extent to which these may be reused by you. An integral feature of this Site is that live employment opportunities are posted onto the Site by or on behalf of employers and business owners and individual users post CVs. As a result since We have not created all the features of this Site We do not own all the intellectual property rights of every aspect of the Site.

3.2 “User Content” means all information, data, text, software, photographs, messages or other materials submitted posted or displayed by you and other users (including employers) on this Site.

3.3 The submitter of User Content retains all intellectual property rights in it and is responsible for protecting those rights.

3.4 Subject to clause 3.5 We claim no ownership or control over any User Content.

3.5 We reserve the right to refuse to accept, post or transmit any User Content we choose subject to the terms of our Privacy Policy.

3.6 All material on this Site other than User Content is owned by Us and as a result the copyright and all other intellectual property rights (including all database rights, trade marks, text, graphics, code and links) belong to Us and are subject to Crown Copyright protection and may be reused subject to the terms of the Open Government Licence.

4. Your Use of This Site

4.1 You should keep your login and password details secure and not disclose these to anyone else including a third party.

4.2 You should only use this Site for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, this Site by any third party.

4.3 You should not post or include any harmful or illegal material when using this Site. If you misuse this Site We may:
a) remove your Universal Jobmatch account from this Site;
b) take other action to prevent misuse including referral to the relevant law enforcement authorities.

5. Online government services or transactions

5.1 When using the Site, you may access an online government service or transaction that is delivered by another government department or agency. Each of these services will have its own terms and conditions or end user licences that apply only to that service. Users of any service should make sure they have read the relevant terms and conditions before completing that transaction.

6. Links from the Site to other sites

6.1 Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

6.2 While We make every effort to keep the Site up to date, We don’t:
a) provide any guarantees, conditions or warranties as to the accuracy of the information on the Site;
b) approve of any opinions of others using this Site.

6.3 If you rely on any of the information posted by other people using this Site you do so at your own risk.

6.4 We don’t accept liability for loss or damage incurred by users of the Site, whether direct, indirect or consequential, whether caused by tort, breach of contract or otherwise. This includes loss of:
- income, sales or revenue
- business
- profits or contracts
- anticipated savings
- corruption of data, information or software
- goodwill
- tangible property
or wasted management or office time in connection with our Site or in connection with the use, inability to use, or results of the use of our Site, any websites linked to it and any materials posted on it. This condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

6.5 Clause 6.4 above does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

7. Governing law and jurisdiction

7.1 Except as set out in clause 7.2 below any disputes relating to or arising from the Site shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.

7.2 If your usual residence is in Scotland any disputes relating to or arising from the Site shall be governed by and construed in accordance with the laws of Scotland and shall be subject to the exclusive jurisdiction of the courts of Scotland.

8. Information about you and your visits to the Site

8.1 You are responsible for the accuracy of your CV, cover letter or any other information that you place on this Site.

8.2 You should not be asked to reveal personal details such as
- bank account details,
- National Insurance number,
- date of birth,
- driving licence or utility bill information.

8.3 The personal details listed in 8.2 above should not be given to Employers as they are not relevant to the application process.

8.4 You should not pay any fee upfront for help with job searches or training.

8.5 During the job application process you may be required to have a criminal records check. These are no longer called CRB checks but instead are called Disclosure and Barring Service (DBS) checks and can only be initiated once an offer of employment has been made to you. You are advised to consider the information on this site to ensure that any proposed criminal records check is appropriate and necessary for the advertised position and is being undertaken by a legitimate organisation.

8.6 You should not let any interview take place in your own home.

8.7 You should not provide a photograph of your self until a job offer is received.

9. Virus protection

9.1 We make every effort to check and test material at all stages of production, however you must take your own precautions to ensure that the process which you employ for accessing this Site does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system.

10. Viruses, hacking and other offences.

10.1 Our Site must not be misused by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. Attempts should not be made to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. Our Site must not be attacked via a denial-of-service attack or a distributed denial-of-service attack.

10.2 By acting contrary to the above, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.
